High Court takes cognisance of minor’s sexual assault by suspended Delhi Government officer

The Delhi High Court has taken note of a case involving the sexual assault of a young girl by a suspended government officer named Premoday Khakha. The court has instructed the authorities to ensure that the survivor’s identity is kept confidential. The Chief Justice and another judge have started a public interest lawsuit due to the incident. The court has emphasized the need for the survivor to receive protection and compensation. It was revealed during the hearing that the girl is currently in critical condition in a government hospital. The court has requested reports from the Department of Women and Child Development, the police, and the central government. The court’s full order is still pending, and the case will be heard again on September 14. The National Commission for Protection of Child Rights has also taken note of the matter and found some instances of non-compliance with regulations by the authorities. The lawyer said they will make an official report. The officer who was suspended is accused of raping the girl multiple times and causing her to become pregnant. The police arrested him on August 21 and he is now in jail. His wife, Seema Rani, is also in jail for giving the girl medicine to end her pregnancy. Khakha allegedly raped the girl multiple times from November 2020 to January 2021. She was staying at the accused person’s house, who was a family friend, after her father died on October 1, 2020, as the police had previously mentioned. The victim then gave her statement to a magistrate at a hospital, leading to the arrest of the two individuals. The police have registered a case against them under the POCSO Act and Indian Penal Code sections 376(2)(f) and 509, which involve rape and actions intended to disrespect a woman’s modesty. Additionally, the police have also included charges of criminal intimidation, voluntarily causing hurt, causing miscarriage without consent, and criminal conspiracy, under sections 506, 323, 313, and 120B of the Indian Penal Code, respectively.
